Blowing a breath specimen of over two times the legal limit has cost a Wembley Man his License for 16 months, after driving on two slashed tyres for three miles. 

Forty-eight year old Larrel Davies stood trial at Camberwell Magistrates court on Wednesday accused of Driving whilst being over the legal Limit.

The bus driver of two years pleaded not-guilty at the start of the trial, with the defence stating that “Mr Davies coughed whilst the breath specimen was taken meaning he could of regurgitated, which renders the sample invalid”.

Davies, told the court he was out driving as he had just had an: “argument with the missus”. Police  stopped him on Brixton Road after they followed him for an estimated three miles with two slashed tyres. After failing the roadside test, the officers brought him into the station to do an EBM test. After giving two samples of breath one tested at 82.6mg/l which is more than twice the 35mg/l limit.

After receiving the results for the test Davies “Swayed and leant his head on a cupboard with his eyes closed” Sargent Jefferies of the MET police told the court.

As well as the 16 month driving Ban, Davies was also handed a £540 fine.
