Ajay Singh Bhatti, a Computer Engineering Student of Greenwich, has been charged with 2 assaults and trespassing. The incident took place on the 27th September 2017 at Ealing Broadway underground.

On the 13th December at the City of London Magistrates, the defence presented the court with CCTV footage. The footage showed the defendant wandering around “aimlessly” and eventually walking on to the underground train tracks before he assaults the two complainants.

Bhatti, 22, explained from the witness box that in 2009 he was diagnosed with a brain tumour which causes epileptic seizures, during which he “blacks out” and recollects nothing. He said to the court: “… My medication at the time induced violent behaviour, a day after the incident I went straight to my GP to get it changed”.

After a cross-examination, the prosecution suggested that “the implications of automatism were false” and the defendant’s actions “were caused by alcohol consumption”. The Prosecution put forth to the Magistrates that the defence’s lack of evidence and non-medical expertise were not enough to prove his innocence.

The trial is to continue on January 10th, 2018 for sentencing.
